The Court of Appeal will deliver its ruling on the appeal lodged against Chief Justice (ag) Roxane George’s ruling throwing out Elections Petition 88 of 2020 on Monday.
In 2021, Chief Justice George, S.C., dismissed the election petition which Claudette Thorne and Heston Bostwick filed.
The petition sought to have the results of the March 2, 2020, General and Regional Elections invalidated on serious non-compliance with the Constitution and electoral laws.
Moreover, petition 88 challenged Order 60 of 2020, under which the national recount of the 2020 General and Regional Elections was done.
Originally scheduled for November 27, 2023, the Court of Appeal had postponed the ruling to December 18, 2023, in light of the death of its former Judge Prem Persaud.
In dismissing the petition about two years ago, the Chief Justice found that the petitioners failed to present evidence to support that the conduct of the elections contravened the Constitution and electoral laws.
Dissatisfied with Justice George’s ruling, in June 2021, Attorney-at-Law Roysdale Forde, S.C., who is representing the petitioners, filed an appeal.
The Chief Justice also dismissed a second petition 99 of 2020 on procedural grounds and subsequently appealed.
The Caribbean Court of Justice had ruled that Guyana’s Court of Appeal does not have jurisdiction to hear the appeal filed against the decision of the Chief Justice. (592 Xpress)
