Seeram Seeks High Court Bail After Assault Conviction

National Border Patrol Director Daniel Seeram has moved to the High Court seeking bail after being convicted of assaulting his former wife, Farzana Hamid, and remanded to custody pending sentencing.

Seeram’s bail application is scheduled to be heard on Monday, October 5, before Justice Joy Persaud-Singh. The judge has ordered that he remain at the Sparendaam Police Station lockups pending the hearing and has requested the magistrate’s reasons for the remand order and an affidavit of defence.

The application follows Friday’s conviction before Magistrate Abigail Gibbs at the Sparendaam Magistrate’s Court, where Seeram was found guilty of assault causing actual bodily harm. He was remanded after his attorney, Nigel Hughes, unsuccessfully asked the magistrate to reconsider the decision to keep him in custody pending sentencing.

Seeram is scheduled to return to the Magistrate’s Court on November 2 for sentencing.

According to the High Court application, Hughes is challenging the decision to keep Seeram in custody before the court considers a probation report, victim-impact statement and submissions on aggravating and mitigating circumstances. Seeram has also indicated that he would comply with conditions such as surrendering his travel documents, reporting to police and having no contact with his former wife if granted bail.

The conviction stems from an incident on September 11, 2023, at the Cummings Lodge apartment the couple shared at the time. The couple has since divorced.

During the trial, Hamid testified that she was assaulted during an altercation and sustained injuries to her thigh, arm, breast, eye and wrist. She also testified that her phone was damaged during the incident and that the apartment was damaged.

Seeram denied assaulting Hamid. He told the court that he had merely pushed her while attempting to leave and maintained that she had been the aggressor. The defence also challenged the explanation for Hamid’s injuries.

In delivering her ruling, Magistrate Gibbs found Hamid to be a credible witness and rejected Seeram’s explanation that the injuries resulted from a single push. The court concluded that the prosecution had proved the charge beyond reasonable doubt and that Seeram had not acted in self-defence.

Following the verdict, Hughes pointed to Seeram’s current role as National Border Patrol Director and his national responsibilities, as well as his attendance at previous court hearings, in arguing against his continued detention. Prosecutor Ganesh Hira indicated that the prosecution would abide by the court’s decision but suggested weekly police reporting if bail were granted. Magistrate Gibbs nevertheless ordered Seeram remanded.

The case has attracted attention partly because of Seeram’s public positions. At the time of the 2023 incident, he was Chairman of Region Four and an executive member of the People’s National Congress Reform (PNCR). He subsequently left tand endorsed the People’s Progressive Party/Civic ahead of the 2025 General and Regional Elections. He later became Director of National Border Patrol.

The High Court’s Monday hearing will determine whether Seeram is released pending sentencing. The conviction itself remains subject to the legal processes available to him.
