By Mark DaCosta- The controversy surrounding the recent General and Regional Elections in Guyana has intensified, as the Chairman of the Guyana Elections Commission (GECOM), Retired Justice Claudette Singh, firmly rejected calls from A Partnership for National Unity (APNU) presidential candidate, Aubrey Norton, to annul the September 1 elections. In a public response to Norton, Singh directed the frustrated politician towards the constitutional pathway for challenging the election’s integrity, emphasising the procedural importance of addressing grievances through the legal system. 

Singh’s stance is clear: following the completion of an ongoing recount, any party dissatisfied with the results has the right to initiate an elections petition under Article 163 of the Constitution of our nation. In her correspondence, she elucidated that this article provides the High Court exclusive jurisdiction to evaluate whether the election was conducted lawfully and whether the outcomes may have been influenced by unlawful actions. As she stated, “Any claims of widespread irregularities necessitating a forensic audit or the annulment of the elections… would fall under the purview of the High Court by way of an election petition.”

The GECOM Chairman highlighted the ongoing recount processes specifically requested by the APNU, asserting that this method adheres to established electoral principles. She reassured stakeholders of the commission’s commitment to uphold the will of the people as expressed through their votes. However, critics of the process argue that Singh’s responses indicate a dismissive attitude towards opposition concerns. The APNU has alleged significant breaches in electoral conduct, asserting that returning officers failed to produce adequate statements of poll before any vote declarations. Such administrative oversights, they argue, undermine the election’s legitimacy and warrant a complete reassessment.

Opposition-nominated Commissioner Vincent Alexander has also signalled discontent with the current electoral process, stating, “It’s an administrative infraction which is being brought to your attention before.” The APNU’s demands for a forensic audit show their belief that the integrity of our nation’s democracy is at stake, a view not shared by Singh, who has so far resisted calls for a complete reevaluation of the electoral process.

An exploration or elections petition constitutes a legal effort to contest the validity of the election results after they have been declared. It serves as recourse for those who suspect that electoral malfeasance may have tainted the election, allowing them to present evidence and argue their case in court. Thus, for many, the exploration petition is a crucial safeguard for electoral integrity even after the fact, highlighting the fundamental necessity for transparency and accountability in our electoral processes.

However, Singh’s approach has raised eyebrows, particularly regarding her perceived alignment with the ruling People’s Progressive Party (PPP). Her dismissal of the opposition’s demands hints at a deeper issue of trust and impartiality within GECOM, often viewed as a body that should be above political affiliations. Critics argue that Singh’s firm stance and the seeming reluctance to entertain the opposition’s grievances reflect a bias that jeopardises the very foundation of our democracy. There are growing concerns that this conduct could lead to a further erosion of public trust in GECOM’s ability to manage elections objectively and fairly.

Guyana’s political landscape stands on a precipice as these events unfold. The GECOM’s actions and responses will play a crucial role in shaping the future of our political discourse. As the opposition prepares to pursue an elections petition, the public will be watching closely to see whether justice prevails or whether our electoral democracy is compromised further. The question remains: will GECOM, under Singh’s aegis, uphold the democratic principles that our nation strives for, or will it succumb to political pressures that threaten to undermine our electoral integrity?
