Revocation of permit for Farnum’s Playing Field & stop order for ongoing construction

Greetings of peace.
Since the last correspondence on 1st September 2025, the residents note with horror at the rate of construction ongoing on the eastern portion of Farnum’s Playing Field, Subryanville. The City Council’s inaction to stop this illegality of the rapidly erecting construction of building in Farnum Playing is resulting in more finacial & other expenditure by Mae’s School/Mr. & Mrs. Sugrim which will not be allowed to be established as a defence. Mae’s school not only is in breach of its duty of care (see in email/s hereinunder) but also in breach of the convenant on the transport at its Third Avenue location. A court order obtained by the residents of Subryanville put a stop to the property then owned by Mae’s School at the corner of Church Road & Fourth Avenue being used as a school.
Farnum’s Playing Field was a gift from the then Council, donated Mr. Cyril Farnum, chairmain, as a gift for community recreational usage which included Subryanville, Kitty village in the late 1920s. Obtaining a copy from the deeds registry would verify this fact. Justice Gino Persaud’s decision in Bel Air Park Residents v M&CC established the concept and legality of community property. A mere read of this decision would recoginze the revelance to the Farnum Playing Field as community property. It is unclear under what authority the City Council issued a permit to Mae’s School/Mr. & Mrs. Sugrim to construct buildings on the eastern portion of Farnum’s Playing Field. Once again the unconsulted residents of Subryanville issue a demand to Mayor & City Council for a revocation of the permit granted to Mae’s School/Mr. & Mrs. Sugrim by or before 10th September 2025 and a cesase-and-desist/stop order for the rapidly developing ongoing construction in Farnum’s Playing Field, Subryanville by 8th September 2025. Please see attached photos for a visual of the structure/s being erected. The building materials are now spilling unto the football field. Was the football field also included in the permit? The residents demand a copy of the permit issued by the City Council in March 2025.
 
In any event the unauthorized permit granted expires on 23 March 2026, 2/3 ways into the school year. What is the intention;- to mentally and psychologically affect the students by having them move before the school year ends or to renew the unauthorized permit or otherwise?
Mae’s School in breach of its convenant has no connection with Subryanville other than the property owned in Third Avenue. With all the other non-community property including Durban Park available to the Mayor and City Council, which has chosen to assist this private business, it is difficult to understand the reasons the council gave without the having authority to issue such a permit against the decision of Justice Gino Persaud and the deed of gift.
Once again  We, the residents of Subryanville demand the following:
  • The stoppage of the current ongoing construction at the eastern end of Farnum Playing Field by 8 September 2025
  • The removal of all building material at the eastern end of Farnum Playing Field by 10 September 2025
  • The cancellation of any permits to build and/or use the eastern end of Farnum Playing Field by 10 September 2025
  • The withdrawal of any permits and/or permission given to Mr. and/or Mrs. Sugrim and/or Mae’s School viz a viz Farnum Playing Field by 10 September 2025.
The residents of Subryanville are willing to meet with the City Council to find a speedy resolution to this unauthorized granting of a permit to Mae’s School/Mr. & Mrs. Sugrim.
