UN CYBER CRIMES LAW

The United Nations is currently negotiating a comprehensive Cybercrime Convention that aims to reshape international criminal law and bolster cross-border police surveillance powers to access and share users’ data ¹. The UN General Assembly passed Resolution 74/247 in December 2019, establishing the Ad Hoc intergovernmental committee to elaborate a comprehensive international convention on countering the use of information and communication technologies for criminal purposes ¹. The proposed convention will deal with several topics, such as substantive cybercrime provisions, international cooperation, access to potential digital evidence by law enforcement authorities, including across borders, as well as human rights and procedural safeguards ¹.

NO SPECIFIC TIMELINE for when the UN Cybercrime Convention will be approved, as international negotiations and consensus-building can be complex and time-consuming. However, here are some key milestones:

  1. 2022:The Ad Hoc Committee held its first session to discuss the convention’s scope and objectives.
  2. 2023: The second session took place, focusing on substantive cybercrime provisions and international cooperation.
  3. 2024: The third session is scheduled to continue negotiations, covering access to digital evidence and human rights safeguards.
  4. 2025 or later: The convention is expected to be finalized and adopted by the UN General Assembly, but this timeline may change.

The UN APPROVAL PROCESS  may take SEVERAL YEARS’ time, and the convention’s ENTRY INTO FORCE will depend on RATIFICATION BY MEMBER STATES.

HISTORY

The first efforts to create global cybercrime legislation were in the late 1970s.

The more recent developments include a draft treaty presented by the Russian Federation to the UN General Assembly in October 2017. This draft aimed to establish an international convention to combat cybercrime, but it raised concerns about potential human rights violations.
