BREAKING: IDPADA-G files lawsuit against Gov’t on withdrawal of subvention, violation of contract

The International Decade for People of African Descent Assembly-Guyana (IDPADA-G) has today filed a Fixed Date Application (FDA) against the Attorney General and Minister of Legal Affairs, Mr. Anil Nandlall, SC;  Minister of Finance, Dr. Ashni Singh; and Minister of Youth Sports and Culture, Mr. Charles Ramson Jr. for the non-payment of the subvention (grant) as approved in the National Budget and based on commitment given to the organisation by the Government of Guyana.

The subvention began in 2018 and was stopped, without notice, in September 2022. IDPADA-G sees the withdrawal as unlawful.

IDPADA-G is being represented by attorneys-at-law Messrs Nigel Hughes, Vivian Williams and Ronald Daniels

According to the lawyers: –

  •  There is a legitimate expectation, given the money was granted by the Government of Guyana based on an undertaking in the form annual subvention, paid monthly;
  • The Government has committed itself to an annual subvention which began under the A Partnership for National Unity and Alliance for Change (APNU+AFC) administration;
  • The Government has broken its legitimate expectation therefore the organisation is entitled to the intervention of the court on the violation of this legitimate expectation;
  • The withdrawal of the subvention is a breach of contract;
  • The withdrawal was an abuse of power, unlawful and with no basis;
  • IDPADA-G was not given notice of the withdrawal nor given the opportunity by the government to be heard regarding change in decision.
  • IDPADA-G is also seeking damages.

IDPADA-G Chairman, Mr. Vincent Alexander, said the organisation insists the Government of Guyana be held accountable for its actions and the organisation believes the law is on their side.
